The Failure of the 28-Point Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the tension sparked by the introduction of a new 28-point plan for achieving ceasefire appeared – temporarily – to have been contained. A Washington representative spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, Moscow made its countermove: an extensive attack of aerial bombardment on Kyiv.

The Pattern of Diplomacy and Destruction

The chain of conflicting incidents captured the harsh reality of the outgoing year. By day, negotiation efforts are conducted: positive announcements are released from multiple capitals. Significant resources is allocated on managing certain initiatives. By night, Moscow forcefully demonstrates the world that, for them, conflict continues to be the main instrument for achieving "settlement".

Nocturnal Warfare

As military strikes progressed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was revealed. Ukraine is able to track missile launches from across the border, a capacity afforded by up-to-date information. From vantage locations, military aircraft that had been deployed to counter approaching guided weapons roared overhead – sophisticated military planes provided to Ukraine by NATO members.

Soon thereafter, Kyiv's air-defence systems engaged: several firings targeted at a hostile projectile. This was a modern interception technology at work, presumably provided by partner states. Every firing shakes the surroundings, shaking the windows. The moment of terror quickly becomes sober acceptance: maybe the incoming missile won't strike its target this time, sparing the city from catastrophe and additional electricity failures.

Continuous Dangers

Not long after, a automatic firearm engaged a aerial vehicle in the vicinity, part of a defensive team – almost certainly imported technology. Unfortunately, the bullets missed the opposing UAV – it pressed on overhead toward its destination.

Intermittently, this persisted until dawn. Kyiv greeted the morning news: seven people killed, devastation and heating outages in multiple buildings as a result of the evening attack. As customarily, everyone still maintained normal activities – experiencing conflict. But those entire period encapsulated Ukraine's vital need on Western support – a need that European nations are evidently unprepared to replace in the immediate future.

Failed Diplomacy

The detailed framework from US administration sparked intense emotion, discussion and profound anxiety – and temporarily diverted attention from Ukraine's most significant graft case in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and international summits.

Every new proposal from US leadership follows the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, manages to fend off. They manage the tension but never actually secure success. This trend will, no doubt, endure.

Political Considerations

It is convenient to criticize certain parties of repeatedly advocating Moscow's conditions. But that does not seem to be the complete picture. US administration works based on a premise familiar among experienced diplomats: you cannot secure via talks what you have lost on the battlefield. The American government believes that it is unfeasible to force Russia to abandon the areas that it presently holds in Ukraine's south or east.

The challenge is that while acknowledging this situation, American administration does minimal to discourage Russia, through statements or actions, from assuming that the status quo will not change more in its favour in the months ahead.

Conflicting Perspectives

Therefore, Moscow is certain that duration works to their advantage – that Ukraine and its allies are approaching exhaustion. Their motivation to agree to terms that does not give them the greatest potential benefit is virtually nonexistent. There may be numerous efforts to end hostilities, but they will carry on as long as Russia's leader remains completely certain in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still hold out, slowly losing lives and land but preventing a complete military breakdown until situations evolve in its benefit.

Present Conditions

Realistically, there are no real preconditions for a truce. Now, subjective factors are coming into play: political desires to broker a ceasefire and secure international recognition, and Kyiv's double obstacles – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the flag against any plan Kyiv finds unsuitable, so that their priority does not shift toward domestic problems. And although their task will now be considerably more difficult after current events, it remains very improbable that this will modify their basic position.

These two forces are guiding negotiations.

Summary and Prospects

It took a mere seven days to kill the proposed articles of the current initiative. Aggressive and erratic handling of the matter by American leadership, resistance by Ukraine and the remaining European nations, along with pacifying measures of representatives, and finally, recent disclosures, all did their job.

While new proposals based on established approaches are imminent, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to resist political attacks from Washington that are rooted in Kremlin requirements and reflect particular unwillingness to change the course of events, if they stand together and enhance their military capacity at a much faster pace. If they do, neither external pressure nor military threats will be able to overcome them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the foreseeable future, mainly require ongoing international assistance.
